Copy of Stair`s ‘Institutions of the Law of Scotland’, written in or about 1662.
Scope and Contents
The general arrangement is the same as that of the first printed edition of 1681 (except that Titles 18 and 19 appear in reverse order) but the text is generally shorter and illustrated with references to earlier case-decisions, and most of the titles are divided into fewer paragraphs. According to a note inside the front cover, dated Perth, 4th August 1731, this copy was written by Sir Alexander Falconer, Lord Halkerton, in his own hand.
The lists of paragraphs have been omitted at the beginnings of Titles 14-18 and 23-31. There are blank leaves after Titles 21-26 and 28-30. The text is followed (folio 222) by an article apparently in the same hand, entitled ‘Actiones in general and exceptions’ and (folio 290) by decisions of the Court of Session during the years 1661-1663, also apparently in the same hand. At folio iii verso is written the rental of the lands within the parish of Garvock out of which John Keith, Minister of Garvock, craves a stipend. Following folio 311 are the remains of a number of leaves that have been roughly torn out.
