Papers of Henry Cockburn concerning the action of oppression and damages of Lieutenent-General Walter Ker of Littledean against James, Duke of Roxburghe in the First Division of the Court of Session and Jury Court., 1820-1822.

 File
Identifier: Adv.MS.9.1.6

Scope and Contents

General Ker claimed that, through his legal agents, Roxburghe had bribed William Smythe, a former clerk of Ker`s lawyers, to supply material evidence towards the claim of the Duke (then Sir James Innes Ker) to the peerage. Roxburghe`s defence was that Ker`s action was motivated by a desire to insult and harass him in revenge for the rejection of Ker`s claim in the Roxburghe peerage case. Henry Cockburn was a counsel for the Duke, who lost his case in the Jury Court; damages of £3,000 were awarded to the pursuer.
